1. Agreement to Terms

By accessing and using Car Finance Refund Letter ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Car Finance Refund Letter is a document generation service that creates personalized complaint letters for Discretionary Commission Arrangement (DCA) car finance claims.

We are NOT a Claims Management Company (CMC). We do not:

  • Submit complaints on your behalf
  • Negotiate with lenders
  • Handle your claim
  • Guarantee any outcome or refund

You are responsible for submitting the generated letter to your lender yourself.

3. Service Fee

The Service is provided for a one-time fee of £19 (including VAT). This fee covers:

  • Generation of your personalized complaint letter PDF
  • Pre-filled lender contact details
  • Email delivery of the document
  • 90-day data retention

3.1 Payment Processing

Payments are processed securely through Stripe. By making a payment, you agree to Stripe's terms of service and privacy policy.

3.2 Refund Policy & Right to Cancel

Important Notice Regarding Digital Content:

Car Finance Refund Letter provides immediate access to digital content (the generated PDF). By clicking "Generate Claims Letter" and completing your purchase, you explicitly consent to the immediate performance of the contract and acknowledge that you will lose your right of withdrawal (the "cooling-off period") once the download or delivery has started.

Therefore, all sales are final. We cannot offer refunds once the document has been generated. However, if you experience technical issues preventing document generation, please contact us for assistance, and we will ensure you receive your document.

4. User Responsibilities

By using the Service, you agree to:

  • Provide accurate and truthful information
  • Use the generated document only for legitimate complaint purposes
  • Submit the complaint letter yourself to your lender
  • Not use the Service for any unlawful or fraudulent purposes
  • Not attempt to reverse engineer or copy our document templates
  • Not share or resell generated documents to third parties

5. Accuracy of Information

While we make every effort to ensure our lender database and document templates are accurate and up-to-date, we cannot guarantee:

  • The accuracy of lender contact details
  • That your lender will accept or respond to the complaint
  • That you will receive a refund or compensation
  • The outcome of any complaint submitted using our documents

You are responsible for verifying lender contact information before submitting your complaint.

6. Disclaimers and Limitations of Liability

6.1 No Legal Advice

The Service does not provide legal advice. The generated documents are based on publicly available FCA regulations and standard complaint letter formats. For legal advice, please consult a qualified solicitor.

6.2 No Guarantee of Success

We make no guarantees, warranties, or representations about:

  • Whether your complaint will be successful
  • The amount of any potential refund or compensation
  • The timeframe for lender responses
  • Whether you are eligible for a refund

6.3 Limitation of Liability

To the maximum extent permitted by law, Car Finance Refund Letter shall not be liable for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, or data
  • Unsuccessful complaints or denied claims
  • Errors or omissions in generated documents
  • Actions or inactions of lenders or third parties

Our total liability to you for any claims arising from the Service shall not exceed the amount you paid for the Service (£19).

7. Intellectual Property

All content, templates, designs, and materials on the Service are the intellectual property of Car Finance Refund Letter. You may not:

  • Copy, modify, or distribute our templates or designs
  • Use our branding or trademarks without permission
  • Create derivative works based on our Service

The generated document is provided to you for personal use only in submitting your complaint.

8. Data Protection and Privacy

Your use of the Service is also governed by our Privacy Policy. We retain your data for 90 days as described in the Privacy Policy.

9. Termination

We reserve the right to refuse service or terminate access to the Service at our discretion, including if we suspect fraudulent activity or misuse of the Service.

10. Changes to Terms

We may modify these Terms of Service at any time. Changes will be effective immediately upon posting. Your continued use of the Service after changes constitutes acceptance of the modified terms.

11. Governing Law

These Terms of Service are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
