The Role of the Financial Ombudsman Service in Car Finance Claims

The Financial Ombudsman Service (FOS) is a free, independent body settled by Parliament to settle disputes between financial companies and their customers.

When to Use the FOS

You cannot go straight to the FOS. You must:

  1. Complain to the lender first.
  2. Wait for their "Final Response" OR wait 8 weeks without a resolution.

How They Judge Cases

The FOS looks at what is "fair and reasonable," not just the strict letter of the law. They have already ruled in favour of consumers in key test cases (like the Black Horse case), setting a precedent that lenders must treat customers fairly and disclose commissions.

The Process

  • You fill out a form on the FOS website.
  • They request the file from the lender.
  • An adjudicator reviews the evidence.
  • They issue a decision.

Is it Binding?

  • If you accept the decision, it is binding on the lender. They must pay.
  • If you reject it, you can still go to court (though this is rare and risky).

The FOS Deadline

The deadline for consumers to refer a DCA complaint to the FOS has been extended to July 29, 2026. This gives you plenty of time to escalate your claim if the lender rejects it.
